On Tuesday May 15th at approximately 5:00 am officers with the Wichita Falls Police Department responded to the 4500 block of Kell Blvd for a check welfare on a subject that was seen slumped over the steering wheel of a vehicle.
Upon arrival officers located a silver Volkswagen. They made contact with the subject who was sitting in the driver’s seat. He was identified as 19 year old Stacey Payton Stouard Jr. Stouard was not responding and appeared to be intoxicated or under the influence of narcotics. While trying to wake Stouard up and further investigate his condition, officers located in plain view, a black Ruger pistol on the center console that was not in a holster. It was later determined that the firearm had been stolen during a burglary of a vehicle that had taken place the night before in the 4300 block of Berwick.
Stouard began to respond to officers and stated he was ok and that he pulled into United Market St. to sleep because he took two Xanax pills. Stouard stated he was not prescribed Xanax but took them anyways. Stouard stated he was sleepy and wanted to park and sleep it off. Due to his intoxicated state officers placed him under arrest for public intoxication.
A search was conducted of the vehicle based on Stouard `s statement that he consumed Xanax pills that were not prescribed to him and the fact that he had a handgun in his possession while intoxicated. During the search a rolled up cigarette was located in between the front passenger seat and the center console that officers believed to be marijuana. The suspected marijuana was field tested and rendered a positive result for marijuana. The marijuana weighted approx. .1oz.
Stouard was placed into custody and transported to the Wichita County jail. While in transport Stouard began to threaten the arresting officer’s life and the life of his family members.
Upon arrival at jail Stouard was charged with unlawful possession of a firearm, theft of a firearm, retaliation, possession of marijuana and public intoxication.
