Officer cleared by Grand Jury during July 3rd Officer Involved Shooting

The Wichita County Grand Jury met yesterday and cleared Officer Chad Nelson of his actions involving the shooting on 07-03-2014. The Grand jury returned two (2) indictments on Roy Phillip Johnston for Aggravated Assault on a Peace Officer.

This incident involved Officers of the Wichita Falls Police Department being dispatched to 5516 Professional Drive Apartment 229 in reference to a disturbance. Several 911 calls came in from neighbors around this apartment. When officers arrived they could hear the disturbance inside however the occupants would not open the door.

After several minutes of the officers determining alternatives to making entry into the apartment, the door was opened by the female occupant. As Officer Nelson moved the female out of the doorway he observed Johnston with a long gun inside the apartment. Johnston began lowering the long gun in the direction of Officer Nelson and Officer Michael Poirot at which time Officer Nelson discharged his handgun at Johnston. Johnston was struck one (1) time in the torso.

Officers immediately requested medical care to the scene for Johnston and began providing first aid to him.

The internal investigation by of the Office of Professional Conduct is in the final stages of completion.
